Permanent residence permit

The decision to issue a permanent residence permit is given for an indefinite period. The residence card itself is valid for 10 years, which means that the card must be replaced every 10 years as part of the card replacement procedure. However, there is no need to reapply for a permit and go through the process of obtaining one. The permanent residence permit entitles you to work in Poland without the need for additional documents. A permanent residence permit issued in Poland does not entitle the holder to work in a country other than Poland.
What is a permanent residence permit
Who can obtain a permanent residence card:

• Foreigner with a valid Pole's Card and intends to settle permanently in Poland.
• Person of Polish origin and intends to reside permanently in Poland
• Foreigner who received an asylum in Poland.
• Victim of human trafficking and meet the conditions set out in the Aliens Act.
• Foreigner, that immediately before applying for a permanent residence permit, has been consistently residing in Poland for at least 5 years on the basis of refugee status, subsidiary protection or a residence permit for humanitarian reasons.
• Child of a citizen of Poland, remaining in the custody of his parents.
• Child of a foreigner who has been granted a residence permit or a long-term EU residence permit on the basis of parental rights.
• Foreigner, that has been married to a Polish citizen for at least 3 years prior to the date of application for a permanent residence card, and immediately before submitting this application has been permanently on Polish territory for a specified period of at least 2 years on the basis of temporary residence permit (karta czasowego pobytu), granted in connection with the marriage with a Polish citizen or in connection with obtaining refugee status, subsidiary protection or consent to stay for humanitarian reasons.

The permanent residence permit offers a number of advantages, in particular:

• Right to work in Poland without a work permit.
• Grounds for a legal stay of up to 10 years.
• Entering and staying in the Schengen countries.
• Acquisition of real estate in Poland without additional permits
• Acquisition of land in Poland without additional permits.
• Getting credit from Polish banks, including mortgages.
• Ability to apply in Poland for visas to non-Schengen countries.
• Possibility of doing business as a private entrepreneur (działalność gospodarcza).
• Free education in Polish institutions.
• The possibility of obtaining Polish citizenship.

If the application for a permanent residence permit (zezwolenie na pobyt stały) was submitted during the foreigner's legal stay and it contained no formal defects or formal defects were corrected in time, the voivode puts a stamp in the foreigner's travel document confirming the application. A foreigner's stay is considered legal from the moment of application until the date on which the decision to issue a permanent residence permit becomes final.
NOTE: A stamp in a travel document does not give a foreigner the right to travel in other Schengen countries, while a foreigner can go to the country of origin, but to return to Poland he or she must obtain a visa, if he or she comes from a country to which requirements apply.
    How to get a permanent residence permit
    The procedure for obtaining a permanent residence permit (karta stałego pobyt) takes placeat the Voivodeship Office in the foreigner's place of residence.

    The application must be submitted by a foreigner legally residing in Poland, i.e. no later than the last day of his/her legal stay (e.g., the last day of his/her temporary residence card or visa).

        A permanent residence permit (permanent residence card) allows the right to travel to other Schengen countries. However, the stay of a foreigner on this basis cannot exceed 90 days within 180 days. If a foreigner intend to stay longer than this limit allows, he or she must legalize his or her stay in accordance with the rules in force in that country.
