What is a negative decision and how to appeal it

A negative decision is an official document in which the voivode refuses to grant a residence permit and states the reasons. You have the right to submit a written appeal to the Head of the Office for Foreigners (Szef UdsC) through the same voivode. The appeal must be written in Polish and signed. If the appeal is submitted on time, the first decision does not become final, and your case is reviewed by the second-instance authority.

In the second instance, the Head of UdsC may:

cancel the refusal and issue the permit,
uphold the refusal without changes,
cancel the refusal and return the case to the voivode for reconsideration.

If the second instance also refuses, you have 30 days to file a complaint with the administrative court, but a court complaint does not legalize your stay. After receiving the final refusal, you are obliged to leave Poland within 30 days, and a new residence application submitted during this period will not be considered.

What is a negative decision?

This is a decision made by the voivode that denies you a residence permit in Poland. It must include the legal and factual reason for the refusal, which allows you to understand the grounds for the decision.

How much time is there to file an appeal?

You have 14 days from the date of receiving the decision to file an appeal with the Head of the Office for Foreigners. Within this period, you must prepare and submit a written statement in Polish through the voivode.

Where to file an appeal?

The appeal is submitted to the Head of UdsC through the voivode who issued the negative decision. You can submit the documents at the voivodeship office or send them by mail.

Can you stay in Poland during the appeal process?

Yes. Timely submission of an appeal means that the first-instance decision is not final, so your case is still under review, and you continue to stay legally in Poland until the second-instance decision is made. However, after a negative decision by the Head of UdsC, you are obliged to leave Poland within 30 days if you do not have another valid residence document.

What documents should be added to the appeal?

In addition to the appeal letter, you must provide all documents confirming that you meet the requirements for obtaining the permit: a valid rental agreement, insurance, bank statements, employment contracts, missing certificates, etc. We will help you compile a complete list of the required documents.

How long does the appeal process take?

What to do if the second instance also refused?
